The legal theory behind the Miranda warnings (the obligation of an arresting officer to tell you that you have the right to remain silent and to an attorney even if you cannot afford one) is very basic. If you are not aware of your Constitutional rights, you cannot avail yourself of them and for all practical purposes don’t have them. But that only applies to certain circumstances under criminal law. For most things, and especially if you are a small business owner, you can forget it. What you don’t know can cost you plenty. And there are no Miranda warnings for small business entrepreneurs. You have a million balls to keep in the air at the same time. But you really owe it to yourself to learn all you can about how the law applies to your situation. Learning the hard way should not be an option.
